IAN GUNTON: MANAGING DIRECTOR
Ian is Managing Director of CNS and founded the business in 2006. Having previously worked for large main contracting businesses as an Engineer and Planning Manager, Ian transitioned into professional services in 2004. He now acts regularly as an Expert Witness on matters of Delay and Disruption and is a specialist in delay analysis, dispute resolution and time related disputes.
Ian has 33 years’ experience in the Construction, Engineering and Process Industries, with a strong grounding in project Planning and Programming.
Ian has been appointed as an Expert Witness and lead advisor on many complicated time-related disputes supporting leading construction law firms and contracting organisations. His recent work includes high-profile cases on the Shangri-La Hotel at the Shard, Beetham Tower in Manchester, the Royal Academy of Arts in London, the Aquatics Centre and Olympic Stadium.
Ian has knowledge and understanding of all the major forms of Contract which include, JCT, FIDIC and NEC and regularly presents and gives talks on the NEC form of Contract in respect of time and planning. His background is multi-disciplinary and his project experience includes Building (including residential, retail, high rise, healthcare and office), Power and Heavy Civil engineering.
Ian is experienced in ICC arbitrations, Mediation, Arbitration and Adjudication procedures and boasts an incomparable passion for the work CNS does and its highly valued and loyal clients and staff.
KATHERINE MORRIS: ASSOCIATE DIRECTOR
Katherine is an established Delay Analyst and Expert Witness on matters of delay and planning. She has 24 years’ experience in the industry and is a highly valued member of our team having worked with the business for 10 years. Katherine provides advice on programme construction and compliance with Contracts, delay and disruption analysis for management of change through live programmes, retrospective delay analysis and expert reports for adjudication. She holds experience with most forms of contract including NEC, JCT and FIDIC.
A Masters educated engineering professional, Katherine has substantial experience of working on multi-disciplinary projects including civil engineering and process infrastructure, building (in particular large mixed use developments, commercial, property, hotels, private residential, student accommodation, retail and apartments) and on a range of significant power sector projects including biomass & onshore windfarms.
Katherine’s experience covers delay & disruption, expert determination, independent assessment, expert witness in adjudication, procurement, planning & programming, project controls, commercial strategy, project audit and project recovery.
During her time with CNS Katherine has been integral in the preparation, negotiation and successful settlement of various complex claims, with appointments as a forensic planner and an expert. She regularly delivers seminars on Contract Programme Planning, Monitoring and Change Control, NEC3 and the planning protocol for our clients.
RAY WOOD: ASSOCIATE DIRECTOR
Ray’s planning and analytical abilities have been honed by his 30+ years’ experience in the construction industry, during which time he has worked in multiple sectors including building, civil engineering, rail, power and energy in the UK, Europe and internationally.
For the last 10 years Ray has worked as a specialist consultant in the field of forensic delay analysis and on several occasions has acted as Expert Witness on time and planning related matters. The intervening years have seen Ray work on many complex projects under different forms of contract preparing forensically researched and substantiated extension of time claims for mediation and adjudication. Specialties include dispute and litigation programming, EOT & forensic analysis, post contract claims reviews, tender planning and analysis, and recovery programming for delayed projects in need of rescue.
Ray started his career as a time served electrician and progressed into the positions of M&E project management and commissioning of highly complex water treatment plants and utilities projects. This specialist knowledge and expertise was integral in his development as a Planner as he learnt to integrate design, procurement, heavy civils construction and M&E works and commissioning into logic and dynamic networked programmes for both tender and contract planning. This role naturally encompassed the programme analysis of delays and preparation of extension of time claims.
STEVE HALL: ASSOCIATE DIRECTOR
Steve started work in the Construction Industry in 1967 and has gained significant experience on a wide range of projects including major infrastructure and building projects such as motorways, bridges, water & sewerage treatment works, industrial projects, multistory structures, hospitals, residential projects and power stations. He is a Fellow of the Chartered Institute of Building, a Fellow of the Chartered Institute of Arbitrators, and a Member of the Royal Institute of Chartered Surveyors.
Steve is proficient in the use of construction planning and delay analysis techniques including Time Location, Line of Balance Charts, Bar/Gantt Charts and Precedence Network Diagrams to present and explain the matters claimed and reasons for extensions of time where applicable. Steve has experience in all matters of contract administration and planning / programming contract documentation. He has many years’ experience of handling a wide range of disputes working closely with Arbitrators and claimants.
Steve has knowledge and understanding of all the major forms of Contract which include NEC, JCT, ICE, GC/wks/1 and 3, FIDIC and is highly knowledgeable of Primavera, Asta and other popular planning software.
AIDAN CASSIDY: SENIOR PLANNING CONSULTANT
Aidan has over 35 years’ construction industry experience involving both contract and commercial management together with engineering and construction activities.
He is a widely experienced consultant with a multi-discipline skill-set and an ability for diagnosing and resolving issues developed through working in main, sub-contract and consultancy environments.
Initially, Aidan worked with national Main Contractors, moving from site engineer to Project Manager on various civils, building and process engineering projects.
Moving on, Aidan worked for a reinforced concrete specialist sub-contractor as Contracts Manager and then as a Company Director, responsible for the company’s contract and commercial management together with marketing and estimating.
In 2008 Aidan transitioned into professional services, providing consultancy services to the building and construction industries utilising his breadth of knowledge to resolve commercial issues.
Aidan’s experience encompasses; programming, extension of time claims, contract and commercial management; engineering, quantity surveying, estimating, project management and design co-ordination, and includes the preparation and defence of claims and resolution of disputes through negotiation, adjudication and litigation.
Aidan has worked on a variety of civil engineering and building projects including; roads and bridges, rail bridges, water and wastewater treatment works, airports, canals, sea defence walls, ground remediations, enabling works, power stations, chemical plants and nuclear facilities, hospitals, high-rise buildings, industrial units, offices, supermarkets and sports facilities.
DAVE WEBSTER: NON EXECUTIVE DIRECTOR
Dave offers the clients of CNS 36 years of experience in the construction and engineering industry. He provides his services as a Quantum Expert and advisor on all matters of a commercial nature, particularly claims entitlement and dispute resolution.
Dave qualified as a Quantity Surveyor with a BSc and has an MSc in Construction Law & Dispute Resolution. His practical experience is split evenly between construction companies and professional practice. The majority of this time has been spent protecting the commercial interests of contractors and clients and as a result, includes significant involvement in claims, dispute resolution and expert witness appointments.
Dave has specialised in dispute resolution, advisory and expert witness for over 20 years during which time he became CEO of a leading global dispute resolution practice with over 45 practicing experts and 500 staff. Over a 20 year period he has remained hands on and led teams in all forms of resolution forums including litigation, ICC arbitration, mediation and adjudication supporting major law firms, investors and contractors. However the vast majority of issues have been settled through the successful achievement of a negotiation strategy.
Prior to making the transition to consulting Dave spent over 15 years working for two large contractors heavily involved in preparing and negotiating different claims and establishing the financial consequences of losses of production, delay, changes and general disruption. He also spent time as a Regional Managing Director of a £200m construction business engaged in business planning, project pricing, pre-construction strategies, tender settlement and project delivery. He has broad experience and significant experience in tunnelling and pipelines, civil and process engineering, reservoirs, highways, and power plants.
VINCENT FOGARTY: DIRECTOR
Director of the London business, Vincent is a Quantum Expert and has over 37 years’ experience of major construction, rail and infrastructure projects, with particular expertise in mechanical and electrical (M&E) services. He is a chartered, degree-qualified quantity surveyor and engineer, holds a Master’s in Construction Law & Dispute Resolution from King’s College and is a Member of the Chartered Institute of Arbitrators.
With particular experience on specialist system engineering projects of all natures, size and complexity ranging from in Data Centres, Biopharma, Rail, Airports, Process and Power Plants , some up to £3BN in value.
He has worked with standard (NEC, ICC, FIDIC, AIA, ABT, JCT) and non-standard forms of contracts. He has executed commissions for a variety of clients, including public authorities, private companies, developers and contractors, both in the UK and internationally. Recently completing the settlement of claims and the novation of ground investigation works on the largest rail project in the United Kingdom.
In addition to his expertise as a construction professional, Vincent has experience in a wide range of dispute matters and providing expert advice and evidence. He also assists clients with the formulation of strategy, preparation of documents and case presentation. Vincent has been appointed as a quantum expert on a number of disputes.
TIM HYETT: DIRECTOR
Tim leads our Technical Expert Witness and Advisory offering. He is a Chartered Engineer and Consultant Engineering Geologist with an LLM in Construction Law and degree’s in both Engineering and Maths. He is an established Expert Witness having testified on a number of occasions and has worked in claims & dispute resolution on numerous complex underground projects in the UK and abroad. He has over 30 years’ experience in tunnelling, pipeline and trenchless technologies and has also worked extensively on downstream oil & gas rail and civil engineering projects.
Tim’s quality as an expert and advisor stems from 25+ years of ‘hands-on’ project experience in senior roles providing engineering, commercial, contractual and technical solutions for contractors and employers engaged in the development of major infrastructure, water, energy, transport and underground projects.
A highly versatile resource – equally able to contribute to a multi-disciplinary team or operate autonomously as an expert advisor or impartially as an expert witness. Tim is multi-skilled across the range of engineering disciplines with high ethical standards, extensive safety and CDM awareness and excellent analytical, financial and legal skills. As well as his technical expertise he has broader commercial skills including identification of onerous and conflicting clauses, Front-End Conceptual Estimating (FECE), forensic delay, claims defence and preparation.
DIMITRIOS KALIANIDIS: ASSOCIATE DIRECTOR
Dimitrios is a chartered Geologist and Technical Expert Witness with over 25 years’ experience in the construction industry. His experience has been gained from a multitude of projects, which include sea-defences, railways (including stations), highways, ports, tunnelling (rail + water) and industrial redevelopments. Before his move into dispute resolution Dimitrios worked for major consultants and client organisations. His experience includes data evaluation, design of shallow and deep foundations, slope stability, ground improvement, retaining structures, site investigations, construction supervision and management. Dimitrios has developed strong technical, analytical and management skills in geotechnical assessment, design assessment and construction assurance and supervision with much of the past 15 years spent working on contentious projects or in investigative or forensic roles protecting client’s commercial interests. In recent times he has acted as Client’s Representative on major infrastructure projects including Crossrail, Thames Tideway Tunnel and HS2 as well as being appointed as both lead and referring Expert Witness on large geotechnical disputes. Dimitrios is a core part of the CNS technical expert team and is passionate about client satisfaction, always striving to contribute to team’s success.
